"how the new Hate Crime Legislation (HR 1913) would be an infringement of Free Speech and Religion.

On Wednesday, April 22, the House Judiciary Committee is scheduled to vote on so-called "hate crimes" legislation, which would give "sexual orientation" and "gender identity" the same federal protection as race. If enacted, it would provide federal assistance to state and local law enforcement to prosecute hate crimes. It would also authorize the federal government to investigate crimes where the victim was targeted because he or she belongs to one of the protected groups.

Rep. John Conyers (D-MI) and Rep. Mark Kirk (R-IL) have reintroduced the Local Law Enforcement Hate Crimes Prevention Act of 2009 (H.R. 1913). The earlier plan died when President George W. Bush threatened a veto, describing the idea as unneeded and probably unconstitutional. However, Barack Obama's White House website affirms his dedication to strengthening "federal hate crimes legislation" and expanding "hate crimes protection."

Hate crimes laws are actually "thought crimes" laws that violate the right to freedom of speech and of conscience. Hate crimes laws will have a chilling effect on people who have moral or religious objections to homosexual behavior. Evidence of a person’s beliefs will be used against any individuals who are even suspected of criminal activity.

Let me say this, crime against any person is evil and should be prosecuted, but the H.R. 1913 is not just about stopping crime, it is also drafted to give sexual preference equal legal status as race under federal law. This legislation could be interpreted as a gay bill to inhibit the speech of those who support traditional family values. Bill sponsors claim that free speech activities are protected in this version of the bill, but exemptions can be overturned by courts or targeted for later removal.

Although many supporters of the bill argue that it contains language that would prevent it from infringing upon First Amendment rights, in a debate, Rep. Artur Davis, who supported a similar bill, admitted that a minister could be charged with the hate crime of incitement for preaching that homosexuality is a sin, if a congregant later committed a crime against a homosexual.

In a statement to the bulletin, Catholic League President Bill Donohue noted "The idea of being prosecuted for reading Scripture may seem delirious, but it is just as crazy to think it couldn’t happen. The problem in general with hate crimes legislation is that it invites the government to probe way beyond motive. And in instances like this, it trespasses on free speech and religious liberty. This is a road no defender of liberty should ever want to go down."

Hate crimes laws are unnecessary, as criminal laws already provide criminal penalties for the violent crimes. Additional penalties will subject individuals to scrutiny of their beliefs, rather than focusing on a person’s criminal actions, and will do nothing to prevent crime.

According to the website for Christian Anti-Defamation Commission, "One of the gravest threats to religious liberty and freedom of speech is proposed hate crime legislation. Even while national attention is focused is on the economy and Obama’s radical economic and foreign policy, the far left is at work undermining our First Amendment rights at home with hate crime legislation." It goes on to say, "Now we are on the verge of passing Federal hate crime laws that will be used to silence believers like in Canada, Europe and Australia. 19th Anniversary Open House, Sat, April 18th.

Saturday's 19th Open House was a roaring succcess, eclipsing even last year's in attendance in sales, despite the economic doldrums the country's in, right now.

We went through 60-18½" cheese pizzas (cut into 8 pieces), 200+ bottles of water, 200+ cans of diet Coke and Pepsi, 600 paper plates and almost 1,000 paper napkins. Everyone loved the pizza from Frank's Pizza & Italian Restaurant in Red Lion (Winterstown). Very good Italian food; nice menu. The John Link & Lisa Evans Jazz Duo was awesome, too! They set-up at 10am, and played/sang Sinatra etc etc etc from 11am-2pm. I've invited them back next April for our 20th Anniversary.

I had Dad, Sister Becky, Alan, Jennifer and hubby/former employee Dave, James, Seth, Arthur, Tyler, Jan, former employee Bob, friend/customer Lee, and my humble self in to handle the 1,600+ people who were there on Saturday. Two Winterstown Fire-Police supervised parking; I'd had "Parking in Field" signs printed-up and we got almost 200 vehicles into the lower 1Ҥ acre field, alleviating much pressure on my entrance road and Rt 24, unlike the traffic/parking mess we had last year.

We had a beautiful day in the upper-70°Fs, while the Denver area got blasted with 3-5ft of snow.

As a follow-up to Saturday's Open House, Sunday was also very busy, with scores of people continuing to take advantage of my one-time *19% discount*, carried-over from Saturday. Here are the pics from last Saturday's 19th Open House.

Monday was a rain-out, so I rescheduled jobs, called a Key Staff Mtg for 11am, and the LSCP Crew & Staff went home for the day around 1pm. I stayed until 3pm doing paperwork, working on a new ad, just listening to the rain on the roof. Nice sound after a Winter without any snow, a March with a 5-inch deficit of rain, and now an April where we're catching-up to the April average. I don't mind losing the work days, as we can make those up in the coming weeks and months. The rain is more important. I managed to stay awake until 9pm, and watch anoher episode of "24", my favorite show, next to "Jericho".

The past two weeks have been disappointing, very costly and eye-opening for me, as a major garden center & nursery owner, as we've discovered insect and disease infestations through various blocks of fieldgrown trees. I've removed all diseased and infected trees, and destroyed them. And I've taken another large retail loss. I've next spoken to the one rep whose multiple west coast and southern nurseries are among those 4-5 responsible for this problem, and informed him that I won't be doing anymore business with those businesses, but will now look locally to closer regional nureries, for 2010. I've done this periodically over the past 19 years, ridding myself of other, numerous questionable and irresponsible growers.

Gas prices have risen sharply 10¢ this week, with Unleaded Regular (87oct) at $2.06, Unleaded Premium (89oct) is at $2.16/gal, and Unleaded Super Premium (92oct) is at $2.26/gal, with Diesel rising 11¢, to $2.37/gal. Take a guess, why...

Tuesday, Wednesday and Thursday were days of small LSCP Estimates, minor billing and small LSCP & Maintenance Jobs, post-Open House fervor. We're getting back into the Friday tree installation routine, as per previous seasons. I'm seeing a lot of older (been with us since ealy-90s) customers "resurfce" and need work done; that's gratifying. Apparently, they're "tried other places", and have been sorely-disappointed with the work and results, so they're back with us. And those I pass on to James, or go visit and estimate the job, myself. "Auld Lang Syne" stuff.

Sister Becky flew back to SF on Thursday morning. I hope she finally decides to get out of that socialist hellhole, and move back here with Her Family. Mom & Dad sure do need her and me, in their waning years.

Many Journal entries are best viewed in the Charrington Roughened and the Orlando typefaces. You may already have Century Gothic on your Windows-XP machine, and that's almost always used for the body copy or subheads, so grab it, if you don't already have it; you're reading it now. They're free from my website. Grab 'em! Save them to your HD, and install to C:/Windows/Fonts (folder), thru your WIN XP Control Panel > Fonts > File > Install New Font. Simple stuff; just takes a few minutes.

So what explained the anomaly? GISS's computerized temperature maps seemed to show readings across a large part of Russia had been up to 10 degrees higher than normal. The reason for the freak figures was that scores of temperature records from Russia and elsewhere were not based on October readings at all.
