Rep. Tom McClintock, R-Calif., is working feverishly to reverse federal and state policies that give fish and rivers priority over people in the distribution of water during the worst drought in California history.
The state is now in the fourth year of the drought, and water reserves are running frighteningly low. McClintock said it’s a result of stunningly stupid policies dating back to the last time Democrat Gov. Jerry Brown was in office.
“We haven’t built a major dam in this state since 1979,” McClintock said. “Meanwhile, the population has nearly doubled. We aren’t going to solve our water problems until we begin building more dams. We can’t build more dams as long as the radical environmental laws make their construction impossible.”
Brown chalks up the shortage to climate change, saying higher temperatures mean less snow in the Sierra Nevada mountains and less water come spring.
“If you happen to worship at the church of global warming, you should be pressing very hard to build more dams,” he said. “It means, with a warmer climate, we will not be able to store as much water in the mountains as snow. Therefore, we need to store that water behind dams. Yet, Gov. Brown has been one of the leading opponents to new dam construction.”
If those rules appear hard to believe, McClintock doesn’t blame anyone.
“A year ago, I was beating the drums to sound warnings on these policies, and nobody paid any attention,” he said. “It began to occur to me, the reason they’re not paying attention is because they don’t believe me. They don’t believe that our policy could be so breathtakingly stupid as to dump millions of gallons of precious water in the middle of a drought to adjust river water temperatures.
“But those are the policies. They are being carried out. As our reservoirs now near empty, people are beginning to focus on that finally. Hopefully, it is going to cause a major re-evaluation of the many leftist environmental laws that have built up in our system over the past 20 years or so that are the very definition of lunacy.”
Last week, Gov. Brown imposed water restrictions on many California residents, demanding they reduce consumption by 25 percent and face fines up to $500 if they fail to comply.
McClintock said the restrictions are not coming because reserves are tapped out but because humans are not the government’s first priority.
“We’re now in the fourth year of the worst drought in the history of California,” he said. “Yet, Brown and the environmental left continue to release what little water remains behind our dams, not for essential human consumption but rather to adjust the water temperatures in the rivers so the fish are happy.”
The congressman is working feverishly to pass House Resolution 1668, the Save Our Water Act. The bill would put an end to releasing massive amounts of water during a time of drought. Time is of the essence. Another major water release into the rivers is already scheduled.
“The Federal Bureau of Reclamation has ordered another pulse flow,” he said. “These are massive releases of water, billions of gallons of water. If this order is allowed to stand, they will drain several of our major reservoirs before the end of the summer for the fish, which means there will be no water left for the human population.”
But the issue gets even more maddening for McClintock. He said the biggest problem for the fish is not the drought but another government policy.
“Mainly, we’re talking about a three-inch minnow called the delta smelt,” he said. “In the case of the new orders, it involves steelhead trout. In most of these cases, the principal cause for the decline in the populations has nothing to do with our water projects. It has to do with non-native predator fish that were introduced into our streams and rivers by the government years ago.”
According to Reason magazine science correspondent Ronald Bailey, 50 percent of water in the reservoirs goes to the rivers and streams. And he said the vast majority of the remaining water goes to the farmers. Yet, he said the restrictions are all aimed at the people using 10 percent of the resources. He also said enforcing the restrictions requires a nanny state nightmare.
“What will happen is that they’re going to have to have a whole elaborate enforcement procedure, with people spying on their neighbors and reporting and so forth. It’s a clunky, stupid system to do it,” Bailey said.
McClintock thinks Brown has a lot of nerve imposing the restrictions.
“It’s going to be very hard for him to summon any kind of moral authority to fine people $500 if they waste a gallon of water on their lawn or sidewalk and yet have no problems wasting millions of gallons of water in the pursuit of making the fish perfectly happy,” he said.
The congressman stresses this mess is a result of federal and state policies. He said the House of Representatives is trying to restore sanity to the law, but it is racing against the clock.
“I’m very confident that we will pass that bill out of the House this year, but it will not be in time to prevent the releases that could literally drain to empty reservoirs that are now in California before we even get to the next rainy season,” he said.
Within six months, McClintock said, misguided government policies could mean the end of some towns in his state.
“Copperopolis, a community of about 10,000 in the Sierra Nevada, will simply be without water because the water we had been storing behind our dams had been released during this period for the fish,” he said. “It means that when people turn on their water faucets, no water comes out. It means entire communities dry up and blow away. These are communities of a long-neglected species, called homo sapiens.”
In addition to putting a halt on pulse flows, McClintock said the federal government needs to make other obvious changes to the laws.
“The House has acted several times now to modify those laws, to ensure that there’s an equitable distribution of water and that we approach the Endangered Species Act (ESA) requirements with a little more common sense,” he said.
“For example, why shouldn’t we be meeting these requirements (on fish numbers) by building fish hatcheries? Right now, the hatchery fish are not allowed to be included in the population counts,” he said.
But could the free market solve the problem more efficiently than changing federal laws?
Bailey thinks so.
“Giving secure property rights to water to people would be the first step toward implementing markets,” said Bailey, who believes water is badly under-priced in California, and giving farmers more options for their water could benefit everyone.
“What I would do is give free and clear title to the water to the farmers,” Bailey said. “Then they can decide if they want to farm or if they want to sell the water. My bet is that the price would be sufficiently high that a whole bunch of farmers will say, ‘You know what? I don’t need to raise any rice this year. I’m going to sell my water to San Francisco or Los Angeles.’”
McClintock said that approach fails to take the dire situation of farmers into consideration.
“The problem with that is we’ve already lost about a half-a-million acres of the most fertile farmland in America because of these regulations, compounded by the drought,” he said. “When you turn off the water to an almond orchard, for example, that’s not a one-year deal. Those trees die, and it takes many, many years to regrow them so they’re once again bearing nuts and fruit.”
While California’s water crisis is a perfect storm of a major drought and what he considers extreme California environmental policies, McClintock said the U.S. government is a major player in this, and that means the rest of America is not immune.
“This can come to any community in America at some time in the near future,” he said. “If there’s an ESA biological opinion requiring the release of this water, what that means is fish come first and people can fend for themselves.

A Day In The Life
Up at 6am on Friday, it was another cool 47°F, not-so-sunny morning, as the recycle garbage truck made its usual clanging/banging noise at daybreak. I had some back/hip/leg pain, and took Bayer® 325mg Aspirin right away. After Fresh-Squeezed OJ w/ lots of pulp and French-Roast, Turkish-Grind Coffee, I opened the condo's windows to get some fresh air thru, before the near-80° temps arrived, around midday. I had another UPS delivery coming today, so I had to stick around between 1-5pm to sign for it. I went out at 10am to get some quick errands done, meet with the landscaping company who'll be doing Dad's yearly maintenance project, visit a new BBQ place nearby (they have a very nice menu), and get to the post office. I missed the 9am - 12noon EST streaming Chris Plante Show, WMAL-DC, so I listened to Rush for a little while and got bored; switched over to some computer
Saturday morning was right and sunny, 65°F and muggy, as southern air moved up the East Coast. With coffee and OJ, I checked the weather maps and saw that heavy t-storms were forecast to impact this after by mid-afternoon. That happens here every Spring, no fail; the South, Midwest and Plains get t-storms and tornadoes. After checking the weather and news, I noticed that email wasn't working again, so I decided to drive to Dad's and get all that copper pipe cut-up, bundled and ready-to-go to the local scrap yard, for $2.95/lb (COMEX), next week. I spent 1½-hrs cutting pipe into 4-5ft lengths, and making two bundles, and putting the smaller, oddball pipes with angles, fittings valves etc into heavy plastic 6-mil contractor bags. I left at 11:30 to get to the bank before they closed at 12noon, and then drop-off a load of shirts at the cleaners, which closed at 1pm. Traffic was heavy, due in part to it was Saturday, and part because Memorial Day Weekend was coming right-up, and people were stocking-up. Stores were packed.
Back home by 2:15, I made a Roast Beef Sandwich & Fries Smothered in Gravy, checked the xfinity/Comcast CATV schedule for series marathons, and
Up at 8am on Sunday, I made juice, coffee and Soft-Boiled Eggs w/ Toast in a bowl, and Hash Browns/Fries. Nowhere specific to go, just a couple loads of laundry, some paperwork and bill paying. Rainy, muggy and 61°F, so there wasn't much to do outdoors. Still no email, so I started laundry, chores, paperwork, a couple research topics on Google, and readied some bills for paying. By 11:45am, I needed a break and made a Grilled Cheese & Tomato Soup. I ran out to the local convenience store to get some milk and a carton of smokes, and stopped by Dad's, but he gone out to Weis Market in West York, to do some food shopping. Tomorrow we load-up all the basement's old copper pipe and take it to a local scrap metal buyer. I was screening some "bumper music" I heard used on the Friday Michael Berry Show, from Texas, which I listen to
Awake at 7 on Monday morning, with a lot of hip/leg pain, took aspirin, made OJ and coffee. Email was back and working. The hot, muggy Summer weather is setting-in, and the national/world news wasn't good. The pain began to subside after the aspirin took effect, and I called Dad to see if he was ready to go to the scrap recycler; he wasn't feeling all that good, and wanted to wait until tomorrow, so I scrapped my trip over. I had several other stops needing attention, and got those done. I stopped at the Rite Aid in East York, and got 3 bottles of Bayer® 325mg Aspirin; one to keep in the Jeep and two for the condo. Back home by 11, I caught the last hour of the Chris Plante Show, WMAL-DC, made a quick Egg & Olive Salad Sandwich for lunch, had aspirin for dessert and laid down on the LR couch with my little friend, the coldpak on my left hip. So much for a walk around the neighborhood and some exercise. I woke-up around 2:30pm, and took a call from Dad's new landscaping company's owner, saying that they'd be at his home either Thursday or Friday, to get the revised proposal's Spring Maintenance done, depending upon weather, and how the scheduled jobs in front of Dad, went. I will be changing my plans
I slept-in until 8:30am on Tuesday, and it felt darned good. With no back/hip/leg pain, I made OJ and coffee, had an English Muffin w/ Marmalade, checked the news, weather and even got email. No, I'm not going to vote in the local elections, today. Local elections are like two pigs wrestling in a sleeping bag; a lot of noise, but little notable outcome. The condo's rain gauge read: 1½" and everything was saturated from last night's multiple t-storms. Our condo's lawn mowing and landscape crews couldn't work today, as it was so wet. I'd bet that it'll also affect the company's crews who'll be working on Dad's LSCP Maintenance Project, scheduled for Friday. Damn. I made a Grilled Cheese w/ Ham Sandwich & Potato Salad for lunch, took some aspirin and went out for a short walk around the complex. I ran into 2 neighbors who'd be away for the weekend, and asked me to care for their dogs and cats on Sat-Sun. I've done it before for other neighbors, so it wasn't a problem. At least we had some nice weather here, as compared to last night's t-storms and wind, but Texas and Oklahoma were getting the shit kicked out of them, again. After another several hour stint at the paperwork and bills, I turned-on the History, Discovery and NatGeoTV channels, and watched the news until 11:30. A nice, pain-free day, and I headed upstairs to bed.
Up at 6:30am on Wednesday, partly-sunny and a very cool 43°F, the hip/leg pain was back with a vengeance, and I went for the aspirin right away. Damn, it was nice to be pain-free, yesterday, but that
Awake and up at 7am on Thursday, it was nippy in the condo and I fired-up the furnace to take the chill off the place. Cloudy, drizzly and 49°F, it promised to be better weather for the holiday weekend. I made coffee, OJ and had a muffin, checked the weather, news and email. Mercifully, no back/hip/leg pain, but I took some aspirin anyway. The lawnmower crews showed-up two days off their usual Tuesday morning schedule, due to the heavy rain we had the other day, and I'm guessing that all area landscapers/lawnmowers are well-off their daily/weekly schedules by now, due to weather. Just a hunch,
SHIT! Dad called at 7:30pm and his laptop was hit with a fake-MicrosoftHelp scam virus as he was finishing-up writing checks. He called their number in-the-screen, and allowed access remote to his computer, which is something you NEVER DO! I called their 1-888-554-9392, and got Indians (Bombay or Calcutta) and a bad connection. I told them they were dogshit, that I'd find them and kill them, and to GO FUCK YOURSELVES and your unholy cows! I quickly called Matt, my friend at his home, who owns a leading edge computer store, who advised me to shut it down right away, and bring it into his shop in the morning. I called Dad back, told him to immediately shut it down, disconnected all cables and power cords, and I scrapped my plans for Friday to get his machine into Matt's shop. Plus, we're still waiting to hear from the landscaping company about their arrival date/time to get Dad's maintenance work done. I have a feeling it'll now be next week, due to weather delays. Crap, what next? Nothing I could do tonite, so I watched some Discovery Channel's "Misfit Garage", History Channel's "Pawn Stars", and quit around 11:30pm.
Tomorrow starts a new week here in the "Journal", and everything's in chaos and flux. We don't yet know what damage the MS-Help-fake hackers/virus have done to Dad's laptop; the landscapers have just emailed me that they'll be in "one day next week" to get Dad's Spring LSCP Maintenance work done. This crap shouldn't be happening, not with as many malware precautions and anti-virus safeguards I'd put in-place for his computer. Spartan Computer will figure it out and make it right.

The very definition of the word conundrum is "something that is puzzling or confusing". Here are six conundrums today, in the US:
1. America is capitalist and greedy - yet half of the population is subsidized.
2. Half of the population is subsidized - yet they think they are victims.
3. They think they are victims - yet their representatives run the government.
4. Their representatives run the government - yet the poor keep getting poorer.
5. The poor keep getting poorer - yet they have things that people in other countries only dream about.
6. They have things that people in other countries only dream about - yet they want America to be more like those other countries.
Think about it. That pretty much sums up the USA in the 21st century. Kind of makes you wonder who is doing the math.
These three, short sentences tell you a lot about the direction of our current government and cultural environment:
1. We are advised to NOT judge ALL muslims by the actions of a few lunatics, but we are encouraged to judge ALL gun owners by the actions of a few lunatics. Funny how that works. And here's another one worth considering...
2. Seems we constantly hear about how Social Security is going to run out of money. How come we never hear about welfare or food stamps running out of money? What's interesting is the first group "worked for" their money, but the second didn't. Think about it. And last but not least...

The Middle East is rapidly-collapsing under the subhuman, murderous muslim/islamic riots (muslim Brotherhood) and rule ("arab Spring"), with world crude oil prices projected to hit $200+/bbl, or even higher into the $300-$400 range,

Obama: "Entrepreneurs Don't Build Businesses"
"Last week, President Barack Obama delivered some telling remarks to a fire station full of people in Roanoke, Virginia. I'll save you the trouble of reading the (long and uninspired) speech and provide you with the most interesting part:
"If you've got a business – you didn't build that. Somebody else made that happen." – President Barack Obama, July 13th, 2012.
It would be easy to respond with something along the lines of, "Somebody else made that happen? Who? Who magically imagined the product or service, started the business, built it up, and created the jobs? Who was it? The tooth fairy?" And to some extent, President Obama's statement is so ridiculous as to merit that sort of quick, flippant response.

However, he's not entirely wrong. This reminds me of an argument that Massachusetts Senate Democratic candidate Elizabeth Warren would probably make. If he's talking about a mid-sized or large business, where an entrepreneur has hired additional employees, then at that point the business's success isn't purely that of its founder.
Employees add value to a business through work and ideas. That's why you hire employees, after all. Steve Jobs didn't invent every last detail of the phones, computers, and tablets to come out of Apple over the last decade. There were engineers working on those products who developed them. So, employees help entrepreneurs to build their business. "Somebody else" did indeed play a part in making that happen.
But what makes the president's remarks so inane is the totality of what he's saying. He's not saying that entrepreneurs and employees work together to build a business. It's not a collaborative effort. It's all thanks to the employees. Usually, I can understand the way the president's mind works on most issues by examining it through a pragmatic, liberal, or progressive framework. This one baffles me.
As I explained, I can see that he has some of a point, but he's still just obviously wrong on the broader point. Sure, the employees help to build the business, but the business itself wouldn't exist without the entrepreneur. So, to say to entrepreneurs and to business owners, "...you didn't build that. Somebody else made that happen," is just wrong. It's silly. They did build that by setting the foundation for the business.
Entrepreneurs are almost always the hardest workers in their business. They work a simply insane number of hours to get their idea off the ground. If they succeed (and they face a tremendous risk if they don't), then they'll start to grow and to hire employees to help. Honestly, if I were an entrepreneur and I read those remarks by the president, I would be furious. It's a tremendous insult to the true job-creators in America, entrepreneurs.
In the context of a long, somewhat rambling campaign speech that touched on every issue under the sun, it may seem as though I'm over-exaggerating the importance of a minor thing he said. But President Obama isn't a stupid man, or even one who makes off-the-cuff remarks he doesn't really mean. He's a very smart man, and he meant what he said.
When the most important issues for most Americans are economic growth and job creation, I believe it's essential to know exactly where both candidates stand on the importance of entrepreneurs.
